Terms of Use

The DamaSell platform (the “platform”, “we” or “us”) is operated by [Company legal name], a company registered in the Syrian Arab Republic under commercial register number [Commercial register number], tax number [Tax number], with its address at [Address].

• User: anyone who browses the platform or creates an account on it.
• Seller or advertiser: a user who posts an ad for an item, service, job or property.
• Buyer: a user who contacts a seller about an ad.
• Content: anything a user posts or sends through the platform, including text, photos, prices, messages and data.

• You must be at least 18 years old and have full legal capacity to enter into contracts to create an account, post an ad or make a deal through the platform.
• If you use the platform on behalf of a company or organisation, you confirm that you are authorised to bind it to these terms.
• Anyone whose account was suspended for breaking these terms may not create a new account without our permission.

• Give accurate, up-to-date information when you register and keep it current.
• Your account is personal: do not impersonate anyone, and do not create multiple accounts to get around limits or a suspension.
• You are responsible for keeping your password secret and for all activity on your account. Tell us straight away if you suspect someone has used it without permission.
• We will never ask for your password or a verification code. See our safety tips.

• All ads and messages must follow our posting rules and prohibited items list, which form part of these terms.
• You alone are responsible for the content you post. You confirm that it is true and lawful, that you own the item or are authorised to sell it, and that you hold the rights to the photos and text you use.
• You keep ownership of your content, but you grant us a non-exclusive, royalty-free licence to host, display, copy, reformat (for example resize and compress photos) and publish it on the platform and its promotional channels, for as long as it stays on the platform and for a reasonable time after deletion for backups and legal obligations.
• You may not use the platform to send spam, to harvest users’ data or phone numbers, to access it by automated means (such as scrapers) without our written permission, or to disrupt it or get around its security measures.

• Describe the item or service accurately and honestly, including its condition, defects and real price.
• Make sure you have the legal right to sell, and comply with applicable Syrian law, including rules on licences, taxes and consumer protection.
• For vehicles and real estate: hold the legal documents proving ownership or a valid power of attorney, and show them to the buyer before the deal is completed.
• Honour what you agree with the buyer and deliver what you advertised as described.

DamaSell is a classifieds platform that lets users show items and services and contact each other. We are not a party to any agreement or deal between users. We do not own or sell the advertised items, and we do not guarantee their quality, safety or legality, the accuracy of an ad, the seller’s ability to sell or the buyer’s ability to pay.

• We do not receive or hold payment for advertised items, and we do not currently offer payment, delivery or guarantee services for deals between users.
• Any check we carry out, such as identity verification, is limited by nature and does not mean we vouch for the user or their deals.
• We recommend following our safety tips before any deal.

• We may review ads before or after they are published, and an ad may stay “under review” for a while before it becomes public.
• We may refuse, hide or delete any content, move it to the correct category, or limit its visibility if it breaks these terms, the posting rules or the law, following a justified report, or at the request of a competent authority.
• We try to tell you the reason for a decision whenever possible. If you believe a decision about your ad or account was made in error, you can ask us to review it at ibra.m@hotmail.co.uk.
• We are not obliged to monitor all content in advance, but we act on the reports we receive, and we cooperate with the competent Syrian authorities and provide information to them as the law requires.

• We show the price, duration and features of each promotion before you pay, and payment is made using the payment methods available at the time.
• A promotion increases an ad’s visibility, but it does not guarantee any number of views or contacts, or a sale.
• Payments are non-refundable once the promotion period has started, including if you delete the ad or sell the item before the period ends.
• You get a full refund if the promotion could not be activated because of a fault on our side, or if the ad is rejected before the promotion period starts.
• If a promoted ad is removed during the promotion period because it breaks these terms or the posting rules, the payment is not refunded.
• Refunds due are paid back to the same payment method where possible, within a reasonable time after they are confirmed. To request a refund, email ibra.m@hotmail.co.uk.

• The DamaSell name and logo, the platform’s design and software, and the content we produce belong to us or our licensors and may not be used without our written permission.
• Do not post content that infringes other people’s rights, such as trademarks or photos copied from other websites without permission.
• Rights holders can report an infringement through our contact page.

• We provide the platform “as is” and “as available”, and we do not guarantee that it will work without interruption or errors.
• To the fullest extent permitted by Syrian law, we are not liable for: deals between users and their consequences; content posted by users; indirect or consequential loss, loss of profit or loss of data; or service interruptions for reasons beyond our control, such as power or internet outages or force majeure.
• In any case, our total liability to you is limited to the amount you paid us for paid services in the twelve months before the claim.
• Nothing in these terms limits our liability where the law does not allow it to be limited or excluded, such as fraud or gross negligence.
• You agree to compensate us for any loss or third-party claim arising from your breach of these terms or of the law, or from the content you post.

• You can stop using the platform at any time and ask us to delete your account by emailing ibra.m@hotmail.co.uk, until account deletion is available in your settings.
• We may suspend or close your account, temporarily or permanently, for serious or repeated breaches of these terms, for fraud, where the law requires it, or to protect users. We will tell you in advance whenever that is possible and appropriate.
• When an account is closed, its ads are removed, and we keep some data for the periods set out in our Privacy Policy.
• The sections on intellectual property, limitation of liability and governing law continue to apply after an account is closed.

• These terms are governed by and interpreted in accordance with the laws of the Syrian Arab Republic.
• Before going to court, contact us at ibra.m@hotmail.co.uk so we can try to settle the dispute amicably within 30 days.
• The competent Syrian courts have jurisdiction over any dispute arising from or relating to these terms.
• If any provision of these terms is found invalid or unenforceable, the remaining provisions stay in effect.
• If the Arabic text of these terms and a translation differ, the Arabic text prevails.

We may change these terms from time to time; the date of the latest update is shown at the top of this page. We will tell you about significant changes through a notice on the platform or by email at least 7 days before they take effect. If you keep using the platform after a change takes effect, you accept it.
